These Terms of Service ("Terms") govern your access to and use of the Push Workouts mobile application, website, and related services (collectively, the "Service") operated by Value Forge Consulting LLC ("Push Workouts," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service.
If you are under the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian.
By using the Service, you represent that you meet these requirements.
2. Accounts
To access certain features, you must create an account. You agree to:
- provide accurate and complete information;
- keep your login credentials secure;
- be responsible for all activity under your account.
You may not:
- share your account with others;
- impersonate another person;
- create multiple accounts to bypass restrictions.
We reserve the right to suspend or terminate accounts at our discretion.
3. Description of the Service
Push Workouts provides:
- workout tracking and logging tools;
- fitness planning and progress tracking;
- integrations with health platforms and wearables;
- social features, including profiles, posts, and messaging;
- subscription-based premium features.
Push Workouts is not a medical service and does not provide medical advice.
4. Health Disclaimer
The Service is intended for informational and fitness purposes only. You acknowledge that:
- you use the Service at your own risk;
- we do not provide medical, nutritional, or health advice;
- you should consult a qualified professional before beginning any fitness program.
We are not responsible for injuries, health issues, or outcomes related to your use of the Service.
5. User Content
"User Content" includes any content you upload, post, or share.
You retain ownership of your content, but grant us a worldwide, non-exclusive, royalty-free, transferable license to:
- host, store, reproduce, and display your content;
- distribute and share it within the Service;
- use it to operate, improve, and promote the Service.
You are solely responsible for your content.
6. Acceptable Use
You agree not to:
- violate any law;
- infringe intellectual property rights;
- post harmful, abusive, or illegal content;
- harass or threaten others;
- share explicit or inappropriate material;
- spam or send unsolicited communications;
- attempt to hack, reverse engineer, or disrupt the Service.
We may remove content or suspend accounts at any time.
7. Social Features and Safety
Push Workouts includes social features such as profiles, posts, and messaging. You understand that:
- content shared publicly may be visible to others;
- other users may not be who they claim to be;
- interactions are at your own risk.
We provide reporting and blocking tools, but we do not guarantee monitoring of all content.
8. Subscriptions and Purchases
Certain features of the Service may require payment, including subscriptions and one-time purchases.
8.1 Subscriptions
Billing and Auto-Renewal
Subscriptions are processed through the Apple App Store or Google Play (the "Platform"). By purchasing a subscription, you acknowledge and agree that:
- subscriptions automatically renew at the end of each billing period unless canceled;
- you authorize the Platform to charge your selected payment method on a recurring basis;
- pricing, billing intervals, and applicable taxes will be disclosed at the time of purchase;
- we do not control billing processes handled by the Platform.
Price Changes
We may change subscription pricing from time to time. Any price changes will be communicated to you as required by applicable law and Platform rules.
Your continued use of the subscription after the price change becomes effective constitutes your acceptance of the new price.
Free Trials
We may offer free trials from time to time.
- Free trials may be limited to new users or specific promotions;
- if you do not cancel before the trial period ends, your subscription will automatically convert into a paid subscription;
- you authorize the Platform to charge you once the trial ends.
Cancellation
You may cancel your subscription at any time through your Platform account settings.
- cancellation will take effect at the end of the current billing period;
- you will retain access to subscription features until the end of that period;
- we do not manage cancellations directly.
Refunds
All payments are non-refundable except where required by applicable law. Refunds are handled exclusively by the Platform (Apple or Google) and are subject to their respective policies.
8.2 Lifetime Purchases
We may offer certain one-time purchase options described as "lifetime" access ("Lifetime Purchases").
A Lifetime Purchase grants access to applicable premium features for as long as the Service remains available and supported.
For clarity, "lifetime" refers to the lifetime of the Service, not the lifetime of the user.
We reserve the right to modify, suspend, or discontinue the Service, or any part of it, at any time. In the event that the Service, or a material part of it, is discontinued, we are not obligated to:
- continue providing access to features;
- maintain supporting infrastructure;
- provide refunds,
except where required by applicable law.
8.3 General Payment Terms
- All purchases are licensed, not sold;
- purchases are non-transferable and tied to your account;
- access to paid features may be suspended or terminated if you violate these Terms;
- we may modify or remove features at any time.
Nothing in this section limits your statutory rights under applicable law.
9. Intellectual Property
All content provided by Push Workouts, including software, design, branding, logos, and features, is owned by Value Forge Consulting LLC or its licensors.
You may not:
- copy, modify, or distribute our content;
- reverse engineer the Service;
- use our brand without permission.
10. Health Integrations
If you connect Apple Health, Health Connect, or wearables:
- you authorize us to access permitted data;
- you can revoke access at any time;
- we use this data only to provide functionality.
We do not use health data for advertising.
11. Termination
We may suspend or terminate your access if:
- you violate these Terms;
- we detect abuse or fraud;
- required by law.
You may stop using the Service at any time.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available."
We make no warranties regarding reliability, accuracy, availability, or fitness for a particular purpose.
13. Limitation of Liability
To the maximum extent permitted by law, Push Workouts shall not be liable for:
- indirect, incidental, or consequential damages;
- loss of data, profits, or use;
- injuries or damages related to fitness activities.
Our total liability shall not exceed the amount you paid in the last 6 months, or $100 USD, whichever is greater.
14. Indemnification
You agree to indemnify and hold harmless Value Forge Consulting LLC from any claims arising from:
- your use of the Service;
- your User Content;
- your violation of these Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States.
16. Dispute Resolution
You agree to resolve disputes through binding arbitration, except where prohibited by law.
You waive the right to participate in class actions where permitted.
17. Changes to the Service
We may modify or discontinue the Service at any time without liability.
18. Changes to Terms
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
